What is a plant

Asked by: 318 views Medical Marijuana

I am growing for 3 patients and never have more than 36 plants but am allways taking cuttings or clones and need to to keep my patients with medicine. My question is does the law consider a clone to be a plant and if I had 36 plants and 10 clones is that ok? Before my clone gets big I cut down 10 from the garden.

Under Michigan Law, a clone is a plant. There is a common misunderstanding that a clone without roots is not a plant. Michigan defines “plant” as a marihuana plant that has produced cotyledons or a cutting of a marihuana plant that has produced cotyledons. A “cotyledon’ is the embryonic first leaves of a seedling. This means that when a seed sprouts and produces a leaf, it is considered a plant. Likewise, when you take a cutting to make a clone, you have taken “a cutting of a marihuana plant that has produced cotyledons.” This means that the cutting is considered a plant from the moment you cut it from the mother plant. Under the current definition of “plant”, patients and caregivers must include their clones in their total plant count.
